Is THCA Flower Legal in Texas? Where It Stands (2026)
By Treez

THCA flower sits in a legal gray area in Texas, and no court has settled it. State hemp law appears to allow it. A state drug schedule and a set of health department rules appear to say otherwise. Police in different cities answer the question differently. This post lays out what each side says and what to check before you buy.
The Short Answer
| Question | Where things stand |
|---|---|
| Is THCA flower clearly legal? | No. The question is unresolved. |
| Is it clearly illegal? | No. Some agencies and rules treat it as prohibited, others as permitted, and no court has settled it. |
| Who can buy THC products? | Adults 21 and older (Texas Tribune). |
| Are Delta-8, Delta-10 and THCP legal? | No. The Texas Tribune lists them as banned, and police departments contacted by KUT described possession as a felony. |
Why Is the Answer So Unclear?
Texas has two sets of rules that point in opposite directions.
1. The 2019 hemp law. According to a September 2026 report from Texas Public Radio and KUT, Texas defines hemp to include a cannabis plant's derivatives, extracts, cannabinoids, isomers and acids, THCA included, as long as Delta-9 THC stays at or under 0.3% by dry weight. That law also excludes hemp from the Texas Controlled Substances Act.
2. The DSHS drug schedule. The Texas Department of State Health Services (DSHS) lists hemp-derived THCs as controlled substances, except Delta-9 at or under 0.3%. This language appears to sweep in THCA, which conflicts with the hemp statute. DSHS reinstated its 2021 definitions effective July 31, 2026, after the Texas Supreme Court sided with the state in May.
The Supreme Court's opinion focused on Delta-8, not THCA.
What Is THCA, and Why Does It Matter?
THCA is the raw, non-intoxicating form of THC found in the live cannabis plant. Heat, such as smoking or vaping, converts it into Delta-9 THC. That conversion is why lawmakers, regulators and hemp businesses keep arguing over it.
The "Total THC" Rule
DSHS adopted rules in March 2026 that add THCA into the Delta-9 calculation. The adopted text appears in the Texas Register under Title 25 of the Texas Administrative Code. The rules count 87.7% of THCA toward the Delta-9 limit, which makes high-THCA flower noncompliant for manufacture and sale.
The math works like this: total Delta-9 equals (0.877 × THCA) + Delta-9 THC. Flower with 20% THCA would score about 17.5% on that formula, far over the 0.3% cap.
A Travis County judge temporarily blocked these changes, then the 15th Court of Appeals reinstated them in June, and they are still being challenged in state court. A federal lawsuit, Monti v. Garcia, was filed July 31, 2026, and TPR and KUT describe it as early-stage. Other outlets give different accounts of which court blocked what and when. The Texas Tribune, for example, reports that the smokable-hemp ban remained paused by a court ruling as of late July. Treat any single timeline with caution.
What Do Police and State Agencies Say?
Texas officials do not agree, and several have declined to say:
- DSHS: It "does not regulate the possession of consumable hemp products" and referred questions to law enforcement.
- Texas DPS: "DPS does not determine legality; legality is determined by the courts."
- Austin PD: Products at or under 0.3% Delta-9 are not seized.
- Hays County Sheriff's Office: THCA "will not be legal," but anything labeled hemp or at or under 0.3% Delta-9 "will be considered legal."
- Round Rock PD: Suggested possession could be a felony.
- Travis County DA José Garza: The "risk for arrest is real," but enforcement would be "incredibly difficult" given the lack of clarity.
Where you are in Texas can change how an officer reads the same jar of flower.
What About the Penalties?
For Delta-8 and similar non-natural THCs, every police department called possession a felony. For hemp flower and natural extracts like THCA. The Texas Tribune reports that possession of a Schedule I THC product can be a state jail felony, with 180 days to two years and fines up to $10,000. Whether that applies to natural THCA flower is the open question.
Even if charges are later dropped, "you can't exactly un-arrest somebody."
What Changes Next?
Two things to watch:
- Court rulings. Challenges to the DSHS rules and the schedule are still pending, so a decision could land with little notice.
- Federal hemp definition. Public Law 119-37 redefines hemp by total THC, including THCA. The law firm Vicente LLP reports that the total-THC standard and a cap of 0.4 mg of total THC per container were delayed to December 11, 2026, while the ban on synthetic cannabinoids in hemp products still starts November 12, 2026. Some older sources still list November 12 for the whole change, so confirm the dates with a current legal update.
Other Ways to Stay Careful
- Be 21 or older and carry ID.
- Skip Delta-8, Delta-10 and THCP. The Texas Tribune lists these as banned.
- Keep your receipt and the COA. They show what you bought and when.
- Think before you travel with it. Rules differ by state and by city, so check them first.

Frequently Asked Questions
Is THCA flower legal in Texas right now?
It's unsettled. State hemp law appears to permit hemp at or under 0.3% Delta-9, while DSHS rules and its drug schedule appear to cover THCA. Courts haven't resolved the conflict.
Can I get arrested for having THCA flower in Texas?
It's possible. Enforcement varies by agency. Austin police say they don't seize products at or under 0.3% Delta-9, while Round Rock police suggested possession could be a felony.
How old do you have to be to buy THC products in Texas?
21 or older, per the Texas Tribune.
Is Delta-8 legal in Texas?
No. The Texas Tribune lists Delta-8 as banned, and police departments contacted by KUT described possession as a felony.
Should I ask for a lab report before buying?
Yes. A batch-specific COA is the best evidence of what is in the product.
Bottom Line
THCA flower in Texas is neither clearly legal nor clearly banned. The statute, the agency rules and local police don't line up, and courts are still sorting it out. Ask to see the lab work, stay 21+, and check back here as things change. For legal certainty, ask a Texas attorney.
